By indicating your acceptance, you understand, agree, warrant and covenant as follows:
For and in consideration of the acceptance of my entry into an Atlanta Track Club event or
program in 2020 & 2021, I attest that I am physically fit, have sufficiently trained for and am
mentally and physically capable of participating in a running and walking activity. My
participation is voluntary and is done at my own risk. I understand that my participation is an
inherently dangerous activity and that risks of participating include, but are not limited to, death
and serious bodily injury. I assume all risks associated with participating in this event or program
including, but not limited to, the weather, to include high heat and humidity, conditions of the
road and other race area surfaces, falls, collisions, motor vehicle traffic, the conduct of spectators
and other runners, the possibility of exposure to viruses or illness of any kind. I hereby, for my
myself, my heirs, my administrators and executors, personal representative and my assigns
forever waive, release and discharge any and all rights and claims for damages or losses, whether
monetary or otherwise compensatory, that I may have against: (i) the Atlanta Track Club, its
directors, executive director, officers, employees, members, representatives and agents: (ii) all
sponsors and partners of Atlanta Track Club, their affiliates, their representatives and successors:
(iii) any of the event's officials, participants, organizers, planners, volunteers and (iv) the City of
Atlanta or any jurisdiction the event or program touches for any injuries sustained by me arising
out of my association with, entry in, or participation in the and any pre-, post-, or other race
related activity. I understand and agree that medical or other services rendered to me by or at the
instance of any of the above parties is not an admission of liability to provide or continue to
provide any such services and is not a waiver by any said parties of any right hereunder. I also
acknowledge that should I require transport to a medical facility, I must pay for such
transportation and any treatment provided. I further agree now and forever to hold the above
named and unnamed parties harmless and indemnify, and covenant not to sue them for all
claims, damages, judgments, and costs of whatever nature and form. I agree to abide by all
instructions from Atlanta Track Club officials and I agree to withdraw from the event or program
if such official in his or her judgment and discretion determines that I should not participate
including because my participation poses a threat to the safety of myself or others or because I
did not abide by any instruction given to me. I understand and will abide by the rule that for
safety, no wheeled vehicles or wheeled means of conveyance are permitted. I grant permission to
the Atlanta Track Club and others to use any photographs, videotapes, motion pictures,
recordings or any other record of me for any legitimate purpose. I also grant permission for the
Atlanta Track Club to contact me by email for race-related communications. I understand that
the race entry fees paid by or for me are nonrefundable. The no refund policy applies to any
cancellation of the race for weather or other circumstances as deemed appropriate by Atlanta
Track Club. BIB NUMBERS ARE NOT TRANSFERABLE.

By signing I acknowledge my understanding that my participation in any Kyle Pease Foundation, Inc. event and/or any pre- or post-event activities (collectively, the “Event”) involves rigorous physical activity and that it potentially may be hazardous. I attest and verify that my ability to participate in the Event has been verified by a licensed medical doctor. I expressly assume all known and unknown risks associated with the Event, including but not limited to: loss of or damage to my property; injury (including death); accidents; the effects of weather; and terrain conditions that may vary widely, and that may include uneven and/or slippery surfaces, spectators, participants, and natural and man-made obstacles (including without limitation, vehicles, security barriers, signs, cables, mats, and debris on the course). In consideration of my participation in the Event, I, for myself, my heirs, executors, administrators, personal representatives, successors and assigns, waive any and all rights, claims and causes of action I have or may have against any Race Organizer that may arise as a result of my participation in the Event. For these purposes, a “Race Organizer” is any one or more of the following: Kyle Pease Foundation, Inc. and their affiliates; all governmental agencies representing the territory in which the Event will be held; all sponsors, agents, vendors, and contractors of or for the Event; medical service providers; and the officers, directors, employees, representatives, successors and assigns of each of the foregoing. I hereby agree to indemnify all Race Organizers for all claims and losses (including attorney’s fees and court costs), which may be brought against any one or more of them by anyone claiming to have been injured or otherwise to have suffered loss or damage as a result of my participation in the Event. I further grant full permission to any and all of the foregoing to store, use and/or reproduce my image or likeness by any audio and/or visual recording technique (including electronic/digital) now in existence or hereafter invented, for any legitimate purpose, including commercial sales and marketing purposes. I understand and agree that information about me that is collected by Kyle Pease Foundation, Inc. or the Race Organizers, including without limitation information on this form and my Event results may be disclosed to third parties for any legitimate purpose, including commercial sales and marketing purposes, and that it may be subject to redisclosure by the recipient(s). I acknowledge and agree to abide by any Official Rules for the Event that may be posted at the Event or on the Event’s website. I hereby represent and warrant that I am 18 years of age or older or, if applicable, that I am the parent or legal guardian of the child under the age of 18 years old who I am registering for the Event and that I have the full power and authority to agree to these terms on behalf of such child, and to bind him/her to these terms.In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
